Kevin Marcilliat is an aggressive criminal defense attorney who believes in a client-centered approach to the practice of law, focusing on the specific details of each case to achieve the best possible result for the individual client. Kevin is based out of the Raleigh office and represents clients across the state of North Carolina in both state and federal court. A graduate of Campbell Law School and a recognized member of the Order of Old Kivett for excellence in trial and appellate advocacy, Mr. Marcilliat is a vigorous and experienced advocate who has handled hundreds of criminal, civil, and domestic cases in more than 28 counties across the State of North Carolina.

While at Campbell University's Norman Adrian Wiggins School of Law, Mr. Marcilliat focused on developing his advocacy skills and, as a member of the moot court team, won multiple awards in both local and national advocacy competitions. He also strove to gain practical knowledge of the criminal justice system through internships at the North Carolina Attorney General's Office, Mecklenburg County Public Defender's Office, and Office of the Federal Public Defender in Raleigh. 

Immediately following his graduation from law school, Mr. Marcilliat joined The Law Office of Heather R. Klein, a small firm in the mountains of Western North Carolina. While there, Mr. Marcilliat developed a wealth of experience in criminal defense and secured not guilty verdicts in seven out of ten District Court trials in his first year as a licensed attorney. He firmly believes, regardless of whether someone is charged with a minor misdemeanor or a serious felony, each client deserves to be treated with the utmost respect and an unwavering commitment to the protection of their Constitutional rights.

When he is not fighting for the rights of his clients, Kevin, a native of the Great State of Alabama, enjoys the outdoors and cheering for his beloved Auburn Tigers every Saturday in the fall.

  • Dismissal of a DWI in Wake County Superior Court after the Court found that the officer did not have reasonable suspicion to conduct a traffic stop on the defendant, despite a .09 BAC.   
  • Dismissal of a DWI in Hertford County District Court after the Court found that police officers did not have probable cause to arrest Mr. Marcilliat’s client for impaired driving.
  • Client found NOT GUILTY of Driving While Impaired after a trial in Wake County District Court despite client’s .08 BAC.
  • Client found NOT GUILY of Driving While Impaired after a trial in Bertie County District Court despite client’s 0.18 BAC.
  • Dismissal of a Felony Possession of Cocaine charge in Wake County without deferral or diversion program.
  • Client found NOT GUILTY of Assault on a Female after a trial in Wake County District Court after the Court found that Mr. Marcilliat’s client acted in self defense to evict an intruder from his own home.
